Thanks Ella! You really are as stupid as everyone says. Now that I have your father's name, address, birth date, income and copy of his signature--it's a shopping spree for me and all of my friends. Ellis Herman will be popping up all over the place! Here and there, far and near. Any social security number will do-that's easy to get, too!
Relax. The credit cards bills won't be showing up for at least a month or two. Can you say big screen TV? I'm thinking I need new clothes, too!

My line of work does not find me at Long Realty, Pinnacle Mortgage or Title Security. Just in case you missed it, First Magnus is bankrupt and no longer open for business. Warning people about doing business with a bankrupt company is a moot point. The collection plate wasn't such a good idea after all. Here's an idea- why don't you join the other homeless people who stand on the street corners begging for money. From what I hear tell, you and your dad are pretty good on the street corners. Anywhere along Grant or Speedway should do it. If begging doesn't work, you can always just work the streets. Miracle Mile is where you'll want to start.

I've just received word that the website SPECIALLY dedicated to you and your father is ready to preview complete with commentary and photos. My merry elves have been hard at work these past few weeks. They are to be complimented.
Adding your photos to our website is a nice touch, don't you think? Displaying your mug shots as unscrupulous villians in SEVERAL public forums will alert our good citizens and maybe prevent further crimes. The LONG list of Ella Silveira's "Not Exactly" Statements
1. "This is a true story." NOT EXACTLY. What appears at Ella Silveira's website is a distortion of the truth and outright lies. She has manipulated the facts to satisfy her sick and twisted need for revenge. Ella Silveira and her father, Ellis Herman conspired to commit the illegal crime of mortgage fraud for housing involving many unsuspecting business people in Tucson, who have become victims of her abuse, blackmail and extortion schemes.
2. "My 81 year old father who is a World War II veteran." NOT EXACTLY. Herman Ellis served in World War II. What Ella fails to mention is her father's less than honorable discharge from the Navy. While he receives a modest pension for his military service, he was denied access to a VA home loan program.
3. "The mortgage loan advisor made my father sign many blank loan documents." NOT EXACTLY! Ellis Herman signed the standard package of printed home loan documents as part of the loan application process. If he had signed blank sheets of paper as Ella claims, the underwriter would have declined the loan package as incomplete. Ellis Herman would not have been able to close in a two week time frame if the documents were not signed properly.
4. "The Long agent used Pinnacle Mortgage/First Magnus and Title Security of Arizona. She never gave my father any other options." NOT EXACTLY! The customer chooses the lender and closing title company of his choice, not the real estate agent. Ellis Herman did not make his home purchase or mortgage loan decisions under duress. He chose to purchase a home in Tucson and sought out the assistance of Long Realty and Pinnacle Mortgage.
5. "They increased his monthly income and assets to qualify him for the loan." NOT EXACTLY! Ellis Herman provided the mortgage loan advisor his income documents. This figure was stated on the initial loan application at the time of the face-to-face meeting with the loan advisor. Per policy and in order to meet the loan program guidelines, the income amount had to be verified by the loan processor and included on the final loan application. Hence, two sets of loan applications. It's standard practice in the mortgage lending business. Ellis Herman failed to include his ALL of his social security income, disability and VA benefit documents during his visit with the mortgage loan advisor. Ellis Herman signed an income verification document at the time of the loan application allowing the loan processor to request "official" certification of his total income by the military finance office. The same process occurred when verifying his assets and liabilities. Verifying the income, assets and liabilities is a required step of the mortgage loan program and was not overlooked, waived or amended. Citimortgage would not have purchased the loan if it was missing documents.
6. "I called CitiMortgage when I found out there was a problem and asked if they could please send me the loan documents." NOT EXACTLY! If Ella Silveira called the CitiMortgage requesting her father's home loan documents, she would have been told the following: "You are not the borrower or co-borrower. By law, mortgage lenders CAN NOT provide copies of the loan documents to anyone other than the owner of the loan. In addition, CitiMortgage is not allowed to discuss customer loans with anyone but the owner of the loan." Ellis Herman admitted on several occasions to having "lost or misplaced" TWO separate sets of final loan documents. He claims to have left Pinnacle Mortgage with no loan application paperwork and he also claims he can't remember signing the loan application documents and the loan closing documents. Does Ellis Herman have Alzheimer's disease or is it just a case of convenient memory loss for the purpose of housing for fraud?
7. "Ellis Herman said he was pressured into buying the house in just over two weeks." NOT EXACTLY! Ellis Herman was living in a camper near Davis-Montham Air Force Base and demanded that he be allowed to purchase the home and close the loan in two weeks. Surely, if things were amiss, his daughter would have stepped in to help her father. Where was his daughter during the home buying/mortgage loan process? In reality, Ella Silveria sent her father out to commit the crime, and then (if by magic) appears out of no where, claiming foul when Long Realty refused to buy back the house. Their year long 'campaign of complaints' changed rapidly and on a daily basis.
8. "Herman and his daughter say they were not allowed sufficient access to the house before they bought it." NOT EXACTLY! Ella Silveira did not buy the house, her father did. Ellis Herman did not request a house inspection by an inspector of his choosing. He chose to use a recently completed housing inspection report. He raised no major complaints about the property during the inspection period according to a published article in the Arizona Daily Star. He also chose to use a recently completed appraisal to expedite the loan process.
9. "Silveira, who was disabled by a stroke." NOT EXACTLY! Ella Silveira suffered a stroke as a result of prolonged illegal drug use. Plain and simple, Ella Silveira is a drug addict. Her last employer in Fair Oaks, CA terminated her employment due to excessive absences, poor job performance and failure to pass licensing requirements required to be a certified phlebotomist. Former friends and associates in Fair Oaks, CA said that Ella frequently suffers from periods of delusion, paranoia and schizophrenia, which manifests as disorganized thought patterns (can't remember or recall which lie she last told), hallucinations (she sees things that aren't there) and the inability to distinguish between reality and fantasy(she lives in her own little world of make-believe.) She also exhibits obsessive-compulsive behavior. Ella claims she is unable to work, but sits at her computer obsessively day after day.
10. "Herman's mortgage payments were about $920.00 for a fixed rate loan and he was unable to make the monthly loan payment." NOT EXACTLY! Ellis Herman never intended to make any loan payments despite his monthly income of $2493.00 as verified by the military pay office. CitiMortgage foreclosed when Ellis Herman defaulted, although he could have easily made the payment on his retirement income. Why didn't he? Ellis Herman and his daughter, Ella Silveira miscalculated their ability to coerce the real estate company and the servicing lender. They also thought they could get something for nothing when they demanded that Long Realty buy back the house. State Attorney General Terry Goodard refused to open an investigation despite Ella Silveira's convoluted complaints.
No action has been taken against any business involved in this transaction. Why?
11. Ella Silveria claims that "Long Real Estate agents have lied to police and filed false police reports." NOT EXACTLY! As a part of their protests in front of Long Real Estate offices, Ella Silveira has physically threatened and harassed Long Realty employees while screaming and shouting obscenities. She and her father are disruptive and endanger others. They continue to create unsafe situations during rush hour traffic, which now require Tucson Police officers to monitor their activities. There is nothing peaceful about their protests.
12. "First Magnus/Stonewater?" NOT EXACTLY! First Magnus Financial Corporation filed for bankruptcy on August 20, 2007. She is unable to accept or understand that First Magnus is no longer in business and her father's loan was sucessfully foreclosed upon by CitiMortgage. This legal action will not be reversed or forgiven. Her father's credit is destroyed because he chose not to pay his mortgage payment. He has only himself to blame. Blaming others is the desperate act of a sinister person scamming others to get something for nothing.
13."Honorably Discharged from the United States Navy/Certificate of Retirement/VA Certificate of Eligibility" NOT EXACTLY! Don't be fooled. Fake copies of these documents are available on the internet for download and can be forged just as easy. Ella Silveira is a practiced, professional liar and has a long history of deceiving others. Banks and mortgage lenders must verify the veteran's VA eligibility. Ellis Herman was NOT entitled to use the VA loan program as verified by the Veteran's Administration during his mortgage loan application process. There is no such thing as a "pre-approval" for the VA home loan program.
14. "We have all of the documents to support our statements." NOT EXACTLY! Look carefully at the dates on "estimated cost sheets." All three of these documents are clearly dated February 22, 2007. The close of escrow for the sale was on February 5, 2007. That means that the estimated cost sheets were prepared and dated after the close of sale???Again, many of Ella's "supporting" documents are cleverly faked copies forged for the purpose of deception and theft. It doesn't take a fraud investigator to point out the discrepencies. The glaring error in this instance is the date of close and the date on the estimated cost sheets. Whoops?
15. "Now that the house has been repossessed, Herman and Silveira say they're not sure where they'll live." NOT EXACTLY! While Herman and Silveira are experiencing a set back in "free" housing, they are busy crafting their next scheme. Fortunately, Tucson business owners have been alerted to this notorious pair of theives and are aware of their shell game tactics. The protests in front of Long Realty have indeed brought attention to their cause, but not the kind that Ella Silveira thought would garner public sympathy. Just the opposite has occured. Ella Silveira and her father have been exposed for as crooks that they are and well to known to the Tucson community .

Mr. Mazairz, Rather than suing you for slander, libel, harrassment and cyber stalking, (and in an attempt to resolve this matter before my attorney interceeds on my behalf) he advised me to simply ask you to remove my name, and/or any reference to me on your website. If you fail to do so within the next 72 hours, he will prepare the necesary paperwork and file court documents to bring legal action against you for damages. I have caused you no harm and contrary to what you published at your website, I have never threatened you in person or by written word. As you are aware, I came to the defense of a colleague of mine as a result of the Arizona Daily Star on March 2nd. Information contained in the article was incorrect. As I have pointed out in numerous postings and emails, anyone with a computer is capable of viewing recorded real estate transaction documents. Ms Silveira stated that the home her father purchased was owned by someone other than on the purchase contract. I checked at the Pima County Recorder's website. In fact, the seller of record is exactly who sold Mr. Herman the property. Ms. Silveira made the claim that some other person owned the home than what appeared on the purchase contract. If that was the case, the title company would have never been able to close the sale. Reagardless of what you, Mr. Herman or Ms. Silveira may think of Joe Neal, he is a colleague of mine and a long time family friend. The reporter for the newspaper treatly him unfairly--first by not contacting him allowing him to make comment and further implying that he left town inferring some sort of nefarious activity on his part. He moved to Texas to accept a job which IN FACT allowed Mr.Neal and his family to be closer to his sister who also resides in Texas.

Mr. Mazairz, You are absolutely correct on two counts having just viewed the recent additions to your website. 1. I stand corrected, I am an ex-military wife, however, I am a military mom. I do take exception to your comment regarding my husband. I do not and have never "worn my huband's rank on my shirt sleeve." I didn't have to-I had my own career in addition to raising my four children. It's ironic to note that you would bash and degrade Tom's service to country, yet praise Mr. Herman's for his duty in the Navy.I guess in your way of thinking, military service to country by some is not held in the same light or esteem as others. By the way, Tom's new job? He's a college professor.
2. You are right again!--I have no business in the middle of the real estate transaction between Mr. Herman and Long Realty! Why? Because I was never involved in the transaction in the first place. You continually insinutate that I am somehow privy to whatever transpired before, during or after the transaction and that I am now involved in some sinister plot with "others" in Tucson. I am NOT. Adhere to your own advice and quit making assumptions. It does make you look like an ass. I will restate over and over again that I came to the defense of Joe Neal who was slandered, libeled, and misrepresented by the newspaper reporter and comments posted by Ella Silveira. For the record, if you review the Arizona Daily Star reader response transcrips that Ella Silveira posted at her Wet Paint website (comment #104, item # 2), she clearly states that the owner of the home was someone other than who actually owned the home. She further goes onto acuse Joe Neal of wrong doing, deceipt and fraud. Once again, I find it ironic that she (and you) can hurl insults, offensive remarks, skewed truths and lies, yet when challenged--all hell breaks loose. It's "ok" for Ella Silveira (and you, in her defense) to slander, libel and "spew," but it certainly isn't "ok" for ANYONE else to defend themselves or present the other side of the story. Why is that? I will be happy to aplogize to Ella Silveira and her father the day she apologizes to Joe Neal.
