Listing Long agent Susie DeConcini
Selling Long agent Pam Treece
328 W. 38th Street, Tucson, AZ 85713Listed as a two bedroom, one bathroom house.
Tim Hagyard enlarged opening of wall in bedroom?
On July 29, 2008 it was brought to our attention, that to call a room a bedroom it must meet certain requirements?
What you are looking at in this picture is the first bedroom? with no closet, leading into the second bedroom? with no closet. Please note in the background is the one and only bathroom.
There is a very small storage space behind the toilet that Long agent Bob Treece called a closet.

The only closet in this whole house is behind the toilet.
I think this was a shower at one time.
Below are the pictures of all the bedroom windows.
In the event of an emergency, such as a fire, and etc., these windows are to small to exit, and
Firefighter's and Law Enforcement to enter through.

July 30, 2008
After talking with a Residential Permit Specialist at 201 N. Stone Ave, noted below are the requirements that must be meet in order to be considered a bedroom.
1. To call a room a bedroom it has to be at least 70 square foot.
2. Windows: “Provide egress from bedroom, R310 - Max sill height = 44”, Min. clear opening = 24”H x 20”W
Windows in both bedrooms fail to meet the requirements! Per the City of Tucson - Development Services.
Grandfather clause:
If you alter the original structure of walls, such as to enlarge an opening between kitchen and living room, electrical work, and etc., you are not protected under the grandfather clause.
Seller’s Property Disclosure Statement: By Tim Hagyard / No permits!
“When I purchased property I replaced hot water heater, evap cooler and drain line to kitchen sink.” “ Also replaced some of the water lines.” “I also enlarged opening between kitchen and living room and also between kitchen and back door.” “Put lights in ceiling in most rooms.” “I recoated roof 10/06 - 11/06 W/ White reflective rubber roof coating.” “Replaced evap W/Master cool 1/05.” Replaced blower motor for furnace 5/06.”
Why is it that Tim Hagyard, and his mother Long agent Susie DeConcini think that they are above the LAW, because they are!
